Water Policy

Venues Covered:

  • Monkey Puzzle – No alcohol sold

  • Madison Heights Bowling & Sk8ters – Alcohol licensed premises

1. Legal Context

For Licensed Premises (Bowling & Sk8ters):

Under The Licensing Act 2003, as amended by the Live Music Act 2012, premises licensed to sell alcohol must provide free potable (drinkable) tap water on request. This is a mandatory licensing condition for all premises authorized to sell alcohol for consumption on the premises.

  • Legal Reference:

    • Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010, amended in 2014

    • Condition 4: “The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.”

For Non-Licensed Premises (Monkey Puzzle):

There is no legal obligation to supply free tap water unless alcohol is being served. Venues like Monkey Puzzle, which do not serve alcohol, are not legally required to provide drinking water to customers.

2. Charging Policy for Utensils and Service

While tap water itself must be free of charge in licensed premises, the law does not prohibit charging for:

  • Cups or glasses (especially if using compostable, branded, or takeaway)

  • Table service

  • Use of cutlery or additional amenities not related to the drink itself

As clarified in various guidance and local licensing interpretations, charges may be applied for the service or utensils, but the water must remain free.

3. Our Venue Policy
